Mobile Application Terms and Conditions
Maldives Premier Bank
These Terms and Conditions ("Terms") govern the access to and use of the Maldives Premier Bank ("MPB", "Bank", "we", "our" or "us") Mobile Banking Application ("App") and the services made available through the App.
The App is owned and operated by Maldives Premier Bank Pvt Ltd, a banking institution duly incorporated in the Republic of Maldives and licensed and regulated by the Maldives Monetary Authority ("MMA") under the applicable laws and regulations of the Republic of Maldives.
These Terms constitute a legally binding agreement between the Customer and the Bank. By accessing or using the App, the Customer hereby acknowledges that they have read, understood, acknowledge and agree to be bound by these Terms and Conditions.
1. Definitions and Interpretation
"Account" means any account maintained by a Customer with Maldives Premier Bank Pvt Ltd and accessible through the App.
"App" means the Maldives Premier Bank Mobile Banking Application, including any updates, upgrades, enhancements, modifications, and related services provided by the Bank.
"Bank" or "MPB" means Maldives Premier Bank Pvt Ltd, a bank licensed and regulated by the Maldives Monetary Authority.
"Customer", "User", "you" or "your" means any individual or entity authorized by the Bank to access and use the App.
"Security Credentials" means any username, password, PIN, One-Time Password (OTP), biometric identifier, token, or other security mechanism used to access the App.
"Services" means all banking products, facilities, functions, and services made available through the App from time to time.
"Instruction" means any request, order, authorization, communication or transaction submitted through the App.
"Device" means any mobile phone, tablet, wearable device or other equipment used to access the App.
"Business Day" means a day on which the Bank is open for business in the Republic of Maldives.
"Security Incident" means any event that compromises or may compromise the confidentiality, integrity or availability of the App or Customer credentials.
2. Application of These Terms
2.1 These Terms govern the Customer's access to and use of the App and all Services made available through the App.
2.2 These Terms constitute a legally binding agreement between the Customer and the Bank.
2.3 These Terms are supplemental to and shall be read together with:
- the Bank's General Terms and Conditions;
- account opening documentation;
- product-specific terms and conditions;
- fee schedules;
- privacy policies;
- electronic banking terms; and
- any other agreements between the Customer and the Bank.
2.4 In the event of any inconsistency between these Terms and any product-specific terms, the product-specific terms shall prevail to the extent of the inconsistency.
2.5 By downloading, installing, registering for, accessing, activating, or using the App, the Customer acknowledges and agrees that they have read, understood, and accepted these Terms.
2.6 If the Customer does not agree to these Terms, the Customer must immediately discontinue use of the App.
3. Eligibility and Registration
3.1 Access to the App is available to customers who maintain an eligible banking relationship with the Bank and have successfully completed the Bank's registration, verification, and onboarding requirements, subject to the Bank's approval.
3.2 Access to the App is only available to individuals who have legal capacity to enter into binding agreements under the laws of the Republic of Maldives.
3.3 The Customer shall provide accurate, complete, and up-to-date information during registration and shall promptly notify the Bank of any changes to such information.
3.4 The Bank may refuse, suspend, restrict, or terminate access to the App where:
- (a) the Customer ceases to maintain an eligible relationship with the Bank;
- (b) the Bank suspects fraud, unauthorized activity, or misuse;
- (c) the Customer breaches these Terms;
- (d) the Bank is required to do so by law or regulatory direction; or
- (e) the Bank reasonably considers such action necessary to protect its systems, customers, or interests.
4. Mobile Banking Services
4.1 The Services currently available through the App may include, without limitation:
- (a) viewing account balances and transaction history;
- (b) transferring funds between accounts;
- (c) making domestic and international payments and transfers;
- (d) managing debit cards and other payment instruments;
- (e) accessing account statements;
- (f) receiving alerts and notifications;
- (g) submitting service requests;
- (h) updating permitted personal information; and
- (i) any other services introduced by the Bank from time to time.
4.2 The Bank may add, modify, suspend, limit, or discontinue any Service at its discretion.
4.3 Certain Services may be subject to additional terms and conditions.
4.4 Transaction processing times may vary depending on system availability, regulatory requirements, cut-off times, and third-party service providers.
5. Customer Instructions
5.1 The Bank shall be entitled to rely upon and act on any Instruction received through the App that has been authenticated using the Customer's Security Credentials.
5.2 Subject to applicable law and Section 9 (Unauthorized Transactions), the Bank may rely on Instructions authenticated using the Customer's Security Credentials and may treat such Instructions as having been authorized by the Customer.
5.3 Once submitted, an Instruction may not be cancelled, amended, or revoked unless the Bank expressly permits otherwise.
5.4 The Bank may refuse to act upon any Instruction where:
- (a) the Instruction is incomplete, unclear, or inconsistent;
- (b) sufficient funds are unavailable;
- (c) the transaction exceeds applicable limits;
- (d) the Bank reasonably suspects fraud, money laundering, terrorism financing, or other unlawful activity; or
- (e) the Bank is required by law or regulatory direction to decline the transaction.
5.5 The Bank's records relating to any Instruction or transaction shall be conclusive evidence of the Instruction and transaction unless proven otherwise.
6. Transaction Limits
6.1 The Bank may establish daily, monthly, per-transaction, or other transaction limits for any Service.
6.2 Transaction limits may be amended by the Bank at any time.
6.3 The Bank may decline any transaction that exceeds the applicable limit.
6.4 The Bank shall not be obliged to process transactions involving uncleared, restricted, frozen, or unavailable funds.
7. Transaction Reversals and Error Corrections
7.1 The Bank reserves the right to reverse, cancel, correct, or debit any transaction processed in error, including duplicate transactions, erroneous credits, technical processing errors, system malfunctions, or transactions required to be reversed pursuant to applicable law, regulatory requirements, court orders, or the rules of any payment system.
7.2 Where reasonably practicable, the Bank may notify the Customer of any such reversal, correction, or adjustment. The Customer shall promptly repay any funds incorrectly credited to an Account and shall not knowingly use or withdraw funds credited in error.
8. Security Obligations
8.1 The Customer shall keep all Security Credentials confidential and secure.
8.2 The Customer shall not disclose Security Credentials to any third party.
8.3 The Customer shall take reasonable precautions to prevent unauthorized access to the App.
8.4 The Customer shall notify the Bank without undue delay upon becoming aware of:
- (a) loss or theft of a device used to access the App;
- (b) compromise of Security Credentials;
- (c) unauthorized transactions; or
- (d) suspected fraud or security breaches.
8.5 The Customer remains responsible for all Instructions and transactions executed prior to the Bank receiving notification and taking reasonable action to secure the Customer's access except where losses are attributable to the Bank's fraud, gross negligence, willful misconduct, or failure to comply with applicable laws or regulatory obligations.
8.6 The Bank may require the Customer to change passwords, reset credentials, or complete additional authentication procedures at any time.
9. Unauthorized Transactions
9.1 Upon notification of an alleged unauthorized transaction, the Bank may investigate the matter and determine liability in accordance with applicable laws, regulatory requirements, these Terms, and the circumstances of the case. Nothing in these Terms shall exclude the Bank's liability for losses directly attributable to the Bank's fraud, gross negligence, wilful misconduct, or failure to comply with applicable laws or regulatory obligations.
10. Authentication and Biometric Login
10.1 Where the App permits biometric authentication, the Customer expressly authorizes the use of biometric credentials stored on the Customer's device for authentication purposes. The Bank shall be entitled to treat authentication using approved biometric methods as the Customer's valid authorization.
11. Access to and Availability of the App
11.1 The Bank will use reasonable efforts to make the App and Services available to Customers on a continuous basis. However, the Bank does not guarantee uninterrupted access to the App.
11.2 Access to the App may be temporarily unavailable due to:
- (a) scheduled maintenance;
- (b) emergency maintenance;
- (c) system upgrades or enhancements;
- (d) telecommunications or network failures;
- (e) power outages;
- (f) cyber incidents; or
- (g) circumstances beyond the Bank's reasonable control.
11.3 The Bank shall not be liable for any loss arising from the temporary unavailability, interruption, delay, or suspension of the App or any Service.
11.4 The App and certain Services depend upon telecommunications networks, internet connectivity, mobile devices, operating systems, third-party technology providers, and other services that are not owned or controlled by the Bank. The Bank shall not be responsible for any delay, failure, interruption, unavailability, security breach, or inability to access the App arising from or attributable to any such third-party network, service, system, or device.
11.5 The Customer is responsible for ensuring that the device used to access the App is compatible with the technical requirements prescribed by the Bank.
11.6 The Customer shall maintain appropriate security measures on their devices, including antivirus software, operating system updates, and other safeguards against unauthorized access or malicious software.
12. Fees and Charges
12.1 The Bank may impose fees, commissions, service charges, taxes, or other charges in connection with the use of the App or any Service.
12.2 Applicable fees shall be disclosed through the Bank's Schedule of Fees and Charges, the App, the Bank's website, or any other communication channel determined by the Bank.
12.3 The Customer authorizes the Bank to debit any Account maintained with the Bank for fees, charges, taxes, or other amounts payable in connection with the use of the App or Services.
12.4 The Bank may amend applicable fees and charges from time to time in accordance with applicable laws and regulations.
12.5 The Customer remains responsible for all charges imposed by mobile network operators, internet service providers, app stores or third-party providers in connection with access to or use of the App.
13. Electronic Records and Communications
13.1 The Customer agrees that all Instructions, transactions, records, notices, confirmations, statements, and communications transmitted electronically through the App shall have the same legal effect as written documents.
13.2 Electronic records maintained by the Bank shall constitute prima facie evidence of the Customer's transactions and dealings through the App.
13.3 The Bank may provide notifications, alerts, confirmations, statements, notices, and other communications through:
- (a) the App;
- (b) SMS;
- (c) email;
- (d) push notifications; or
- (e) any other electronic channel designated by the Bank.
13.4 The Customer is responsible for maintaining accurate and up-to-date contact details with the Bank.
13.5 Unless otherwise required by applicable law, any notice, communication, alert, statement, confirmation or other information sent by the Bank through the App, email, SMS, push notification or any other electronic channel shall be deemed received by the Customer when transmitted or made available by the Bank, whether or not the Customer accesses, reads or acknowledges such communication.
13.6 Instructions and approvals authenticated through OTP, biometric authentication or other approved authentication mechanisms constitute valid electronic signatures and authorizations for transactions and instructions submitted through the App.
14. Customer Responsibilities
14.1 The Customer shall use the App only for lawful purposes and in accordance with these Terms.
14.2 The Customer shall ensure that all information provided to the Bank is accurate, complete, and current.
14.3 The Customer shall review transaction confirmations, account statements, and notifications regularly and promptly report any unauthorized transactions, discrepancies, or errors to the Bank.
14.4 Failure to notify the Bank within a reasonable period after becoming aware of an unauthorized transaction may affect the Bank's ability to investigate and recover any losses.
14.5 The Customer shall not:
- (a) use the App for unlawful, fraudulent, or improper purposes;
- (b) interfere with the operation or security of the App;
- (c) attempt to gain unauthorized access to any system, network, account, or data;
- (d) upload malicious software, viruses, or harmful code; or
- (e) misuse any feature or functionality provided through the App.
- (f) jailbreak, root, modify, or compromise the security features of any device used to access the App.
15. AML/CFT and Sanctions Compliance
15.1 The Bank may decline, delay, block, suspend or report any transaction where it considers such action necessary to comply with anti-money laundering, counter-terrorist financing, sanctions, fraud prevention, or other legal and regulatory obligations.
16. Intellectual Property
16.1 The App, including its software, design, graphics, logos, trademarks, content, text, interfaces, and underlying technology, is owned by or licensed to the Bank.
16.2 The Customer is granted a limited, non-exclusive, non-transferable, and revocable right to access and use the App solely for personal or authorized business banking purposes.
16.3 The Customer shall not:
- (a) copy, reproduce, distribute, modify, or create derivative works of the App;
- (b) reverse engineer, decompile, disassemble, or attempt to extract source code;
- (c) remove or alter any proprietary notices; or
- (d) use the App in any manner not expressly permitted by these Terms.
16.4 All intellectual property rights relating to the App remain vested in the Bank or its licensors.
17. Third-Party Websites and Services
17.1 The App may contain links to, or provide access to, websites, applications, platforms, products, or services operated by third parties ("Third-Party Services").
17.2 Such Third-Party Services are not owned, controlled, or operated by the Bank. The Bank does not endorse, guarantee, monitor, or assume responsibility for the content, accuracy, availability, security, privacy practices, products, services, or policies of any Third-Party Services.
17.3 Access to and use of any Third-Party Services shall be at the Customer's own risk and shall be governed by the terms and conditions and privacy policies of the relevant third party.
17.4 The Bank shall not be liable for any loss, damage, claim, or expense arising from or in connection with the Customer's access to or use of any Third-Party Services.
18. Data Privacy and Confidentiality
18.1 The collection, use, processing, storage, retention, and disclosure of Customer information shall be governed by the Bank's Privacy Policy, as amended from time to time. The Privacy Policy forms an integral part of these Terms and Conditions.
18.2 The Bank will collect, use, process, store, retain, and disclose Customer information in accordance with applicable laws, regulatory requirements, and the Bank's Privacy Policy.
18.3 The Customer acknowledges and agrees that the Bank may collect, use, process, store, retain, and disclose Customer information as necessary for:
- (a) providing banking services;
- (b) identity verification and customer due diligence;
- (c) fraud prevention, security, and risk management;
- (d) compliance with legal and regulatory obligations;
- (e) customer support and service administration; and
- (f) operating, maintaining, and improving the App and related services, in accordance with applicable laws, regulatory requirements, and the Bank's Privacy Policy.
18.4 The Bank may disclose Customer information where required by law, court order, regulatory requirement, or competent authority.
18.5 The Customer acknowledges that information transmitted electronically may be subject to risks inherent in electronic communications, despite the Bank implementing reasonable security measures.
18.6 The Customer consents to the Bank engaging third-party service providers, including technology and cloud service providers, for the processing and storage of information where permitted by applicable law.
19. Limitation of Liability
19.1 To the maximum extent permitted by law, the Bank shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the use of the App.
19.2 The Bank shall not be responsible for any loss or damage resulting from:
- (a) system interruptions or failures;
- (b) telecommunications or internet disruptions;
- (c) delays in processing transactions;
- (d) unauthorized access resulting from the Customer's failure to safeguard Security Credentials;
- (e) third-party systems, software, or service providers;
- (f) force majeure events; or
- (g) circumstances beyond the Bank's reasonable control.
- (h) malware, viruses, malicious software, device compromise, or unauthorized access occurring on the Customer's device unless caused by the Bank's gross negligence or wilful misconduct.
19.3 Nothing in these Terms shall exclude or restrict liability that cannot be excluded by applicable law.
20. Customer Complaints and Disputes
20.1 Any complaint regarding the App or Services may be submitted through the Bank's designated customer service channels.
20.2 The Bank shall investigate complaints and respond within such period as may be prescribed by applicable law, regulatory requirements, or internal procedures.

21. App Store and Platform Provider
21.1 The downloading, installation, access to, and use of the App may also be subject to the terms, conditions, policies, and requirements of the relevant application distribution platform, including the Apple App Store and Google Play Store, as amended from time to time.
21.2 The Customer is responsible for complying with any applicable terms and conditions of such platform providers.
21.3 The Bank is not responsible for, and shall not be liable for, any products, services, acts, omissions, or failures of any application distribution platform, mobile device manufacturer, operating system provider, telecommunications provider, or other third party in connection with the downloading, installation, availability, or operation of the App.
22. Force Majeure
22.1 The Bank shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including natural disasters, acts of government, war, terrorism, civil unrest, cyberattacks, epidemics, telecommunications failures, utility outages, or failures of third-party systems.
23. Indemnity
23.1 The Customer agrees to indemnify and hold harmless the Bank, its directors, officers, employees, agents, affiliates, and service providers from and against any losses, claims, liabilities, damages, costs, expenses, or legal proceedings arising from:
- (a) the Customer's breach of these Terms;
- (b) misuse of the App;
- (c) unauthorized activities conducted using the Customer's credentials;
- (d) violation of applicable laws; or
- (e) any act or omission by the Customer.
24. Suspension and Termination
24.1 The Bank may temporarily or permanently suspend, restrict, or terminate the Customer's access to the App immediately where:
- (a) the Bank reasonably suspects fraud or unauthorized activity;
- (b) security concerns arise;
- (c) the Customer breaches these Terms;
- (d) required by law or regulatory direction; or
- (e) the Bank reasonably considers such action necessary to protect its interests, systems, or customers.
24.2 The Customer may discontinue use of the App at any time by notifying the Bank and completing any applicable deactivation procedures.
24.3 Suspension or termination shall not affect any rights, obligations, liabilities, or transactions arising prior to such suspension or termination.
25. Miscellaneous
25.1 If any provision of these Terms becomes unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
25.2 Failure or delay by the Bank to exercise any right shall not constitute a waiver of that right.
25.3 The Customer may not assign, transfer, delegate, or otherwise dispose of any of their rights or obligations under these Terms without the prior written consent of the Bank. The Bank may assign or transfer its rights and obligations under these Terms to any affiliate, successor, or person acquiring all or substantially all of the Bank's business relating to the App, subject to applicable law.
25.4 The Bank may be contacted through its published customer service channels, website, branches, or contact centre.
25.5 These Terms, together with the Bank's General Terms and Conditions, Privacy Policy and applicable product-specific terms, constitute the entire agreement relating to the App.
26. Amendments
26.1 The Bank may amend these Terms from time to time. Where required by law, notice of material amendments shall be provided through the App, the Bank's website, email, SMS, or other communication channels.
26.2 Continued use of the App after the effective date of any amendment constitutes acceptance of the revised Terms.
27. Governing Law and Jurisdiction
27.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Maldives. The courts of the Republic of Maldives shall have exclusive jurisdiction to any dispute arising out of or in connection with these Terms.
